These Terms and Conditions govern the use of charter services provided by Duskwave, operating from 78/4 Sattahip Naval Base Road, Chon Buri 20180, Thailand. By making an enquiry, submitting a booking deposit, or using any Duskwave service, you agree to these terms. If you do not agree, please do not proceed with a booking.

1. Definitions

"Duskwave", "we", "us", "our" refers to the yacht charter operator at the above address. "Guest" or "you" refers to any individual who books or participates in a Duskwave charter. "Charter" refers to the private vessel hire service provided. "Booking Confirmation" is the written agreement between Duskwave and the Guest confirming charter details.

2. Acceptance of Terms

These terms are accepted when a guest submits a booking enquiry or pays a deposit. All guests must be aged 18 or older to make a booking. Guests booking on behalf of a group are responsible for ensuring that all group members comply with these terms and any onboard instructions given by the crew.

3. Service Description

Duskwave provides private yacht charters departing from the Sattahip area, Chon Buri Province, Thailand. Services include the Twilight Harbor Cruise, Outer Islands Day Passage, and Gulf Coast Multi-Day Tour as described on the Duskwave website. All charters are subject to availability and sea conditions at the time of departure.

4. Booking and Confirmation

Bookings are confirmed in writing by Duskwave once availability has been verified and a deposit has been received. The Booking Confirmation will include the charter date, departure time, vessel, inclusions, and total charter rate. No charter is confirmed until written confirmation is sent by Duskwave.

5. Payments

• A deposit of 30% of the charter rate is required to confirm a booking. The balance is due no later than 7 days before the charter date.
• Charter rates are quoted in Thai Baht (฿) and are per charter (not per person), except for the Multi-Day Tour which is priced per day.
• Payment methods accepted include bank transfer and card payment via our payment processor.
• Rates quoted at the time of booking are held until the charter date, regardless of subsequent pricing changes.

6. Cancellation by the Guest

• Cancellations made more than 14 days before the charter date: full deposit refund.
• Cancellations made 7–14 days before the charter date: 50% of deposit refunded.
• Cancellations made fewer than 7 days before the charter date: deposit is non-refundable.
• Full balance payments made and then cancelled fewer than 7 days before departure: a credit toward a future booking may be offered at Duskwave's discretion.

7. Cancellation or Postponement by Duskwave

Duskwave reserves the right to postpone or cancel a charter in the event of sea conditions, mechanical issues, or circumstances that make safe operation impossible. In such cases, guests will be offered a rescheduled date or, if no suitable alternative can be arranged, a full refund of amounts paid. Duskwave is not liable for consequential costs such as travel or accommodation.

8. Passenger Responsibilities

• Guests must follow all safety instructions given by the skipper and crew at all times.
• Behaviour that endangers the safety of others, the vessel, or the marine environment may result in early return to port, at the guest's expense.
• Guests are responsible for disclosing any medical conditions, mobility limitations, or dietary requirements that may affect the charter.
• Consumption of alcohol is permitted in moderation. Intoxicated guests who pose a safety concern may be refused boarding.

9. Intellectual Property

All content on the Duskwave website, including text, images, and branding, is owned by or licensed to Duskwave. You may not reproduce or distribute this content without written permission.

10. Disclaimers

Charter experiences are subject to sea conditions, weather, and factors outside Duskwave's control. Routes, island stops, and timing may vary from those described on the website. Duskwave does not make specific promises about visibility, wildlife encounters, or outcomes that depend on natural conditions.

11. Limitation of Liability

To the extent permitted under Thai law, Duskwave's liability to a guest is limited to the charter fee paid. Duskwave is not liable for indirect, incidental, or consequential losses arising from the charter service, including but not limited to travel costs, accommodation, or lost income.

12. Indemnification

Guests agree to indemnify Duskwave against any claims, costs, or damages arising from their failure to comply with these terms, their behaviour during the charter, or their failure to disclose relevant health or safety information.

13. Termination

Duskwave may refuse service or terminate a charter early if a guest or group poses a risk to safety, engages in prohibited activities, or behaves in a manner that is abusive toward crew. No refund is provided in these circumstances.

14. Governing Law and Dispute Resolution

These terms are governed by the laws of the Kingdom of Thailand. Any disputes arising under these terms will be subject to the jurisdiction of the courts of Chon Buri Province, Thailand. We encourage guests to raise concerns with us directly in the first instance by contacting [email protected].

15. General Provisions

If any provision of these terms is found to be invalid, the remaining provisions continue in full effect. These terms constitute the full agreement between Duskwave and the guest with respect to charter services. Failure to enforce any provision does not constitute a waiver of rights.

16. Changes to These Terms

We may update these terms from time to time. The current version will always be available at this URL. Bookings made prior to any change remain governed by the terms in effect at the time of booking.
